in ontario, canada, a lesbian couple who vowed “til death us do part” on 18 june, 2003, have filed that country’s first ever same-sex divorce action.

the women, aged 41 and 61, sealed their ten-year relationship by marrying just one week after same-sex marriage became allowed under canadian law. far from being as they envisioned, the couple formally separated five days after their “legal” wedding ceremony.

whilst the ruling liberal canadian government has vowed to legalize same-sex marriage across the country, opinion polls have shown that about half of canadians are against the move, and this new issue will surely only add fuel to the flames.

courts in most areas covering the country 31 million people have ruled that the right for same sex couples to marry is now guaranteed by the canadian constitution's charter of rights. however, the federal divorce act has yet to be amended to be applied to same sex marriages.

as divorce law still contains the archaic definition of “a man married to a woman” and the terms “husband” and “wife”, lawyers for the women are asking the court to grant the divorce and to declare the divorce act's definition of a spouse as “unconstitutional”.

the divorce petition in question was filed in the superior court of justice in june, 2004, and will be heard in september. lets’ hope that legislation can be altered in time for those women to get out of getting what they wanted now that they don’t want it anymore. oh wait, that actually is marriage. they did it. amazing.

but lets hope they keep in touch. we really need the outcome of this case. i mean, how awful if marriage actually became something we had to do for life.

This still makes me smile. It's sad to think that a couple who even think they're in love need the backing of a national opinion poll to go ahead (I am not refering to Canada, but mainly to Australia and the US). If only this screening test was applied to allmarriages. If the couple is heterosexual, marriage is virtually thrust upon them after living together for more than two years. By that time it's not a personal or social choice, but a government and judicial dictate.

I know this isn't a thread for discussion of gay marriage per say, but the thought that in the year 2004 referendums are required for the sanctifying of the love between two people is almost humorous. To allow them in and then not allow them out is almost beyond comprehension.

I will get married the second week of August 2004 with my partner, and it's good to know that there are still issues about same-sex marriage/divorce.
It's even more interesting for us because we have the possibility to move to Canada, since we cant go back to the US yet.

Once again i dont think that people wanting to marry a partner of the same sex are doing it to confront everyone with the fact they are being gay, they just want to be married because they are in love and want to have the same rights as married couples do..that's all !

Did the article mentioned by any chance WHY the couple wanted a divorce ?

hi dolcefemme. i apologise if i sound anti same-sex marriage. i'm not. in fact, this case annoyed me mainly because of the negative publicity aspects it throws towards same-sex marriage at a time when some real progress was being made. i happen to love a man, but if i loved a woman, i would expect (demand !) the right to marry.

the article did not mention why they had decided to divorce - this in itself is an example of the prejudice mentioned above. it only stated that a 10 year relationship ended 5 days after they married. as i said, i agree with every individual having the right to marry, but this issue could have done without this complication right now.

marco, exactly !. it's like they want to make a big deal out of this one "divorce". why would it be assumed that relationship isues leading to divorce are confined to heterosexual marriages ?
